In 1949, Taiwan Martial Law was declared, and Taiwan remained under military control until the 1980s. However, as the cross-strait relations improved in the 1980s, when the Taiwan Martial Law was also lifted. This political move paved the foundation of “civilianization” in the law enforcement agencies in Taiwan, which has become the mainstream policy today. This paper will analyze the transition of maritime law enforcement agencies and its legal grounds. Meanwhile, references to the civilianization of the Taiwan Coast Guard will be used as the analytical foundation for further discussion on its legal status under international law.
